A woman charged with assault and battery after a diner said she knocked his "Make America Great Again" cap off now faces deportation. Immigration officers arrested Rosiane Santos on Tuesday, USA Today reports, accusing her of being a citizen of Brazil living in Massachusetts illegally. A lawyer for Santos told Boston.com that she has a green card application pending and is married to an American citizen. She has been released from ICE custody but awaits a court date. She had been arrested by local police Feb. 15 after the restaurant confrontation, which the diner, Bryton Turner, captured on video. "I don’t think ICE or anything would've been involved if it wasn't for the video," Santos' husband told Boston 25 News.

The video—which includes commentary by Turner—shows Santos walking past him from behind and knocking off his cap, which bore Donald Trump's campaign slogan. The police report said she appeared to be intoxicated and told officers Turner shouldn't wear the cap in a Mexican restaurant. "She's been through a lot in her life; she felt she had to stand up for herself and for other people," her husband told Boston 25. After her ICE arrest, Turner issued a statement: "Unfortunately for her this country has laws in place to protect its citizens and they have to be obeyed. That's what makes this country great."
