Darrell Issa is using one of the last weapons he has to try to get Eric Holder to turn over documents related to the Fast and Furious gun-walking scandal. He and other House Republicans plan to file a civil suit against the attorney general this month, he tells NBC News. Their hope is that a federal judge will rule that President Obama's declaration of executive privilege over the documents is invalid.

House Republicans held the attorney general in contempt over his refusal to release the documents in June, but the Justice Department—over which Holder presides—said it would not pursue the charges as a criminal case. That left a civil suit as one of the few options for Issa and his House Oversight Committee; he says it will be filed at some point over the August recess. (More Darrell Issa stories.)
