The Richmond-based appeals court tossed the suit last year, but the school re-filed it, saying it deserves another look following the Supreme Court's June ruling.
That decision left the door open to legal challenges to some parts of the law. It's unclear when the appeals court will reexamine Liberty University v. Geithner, CNN notes. It could seek new arguments from both the university and the federal government.
