Kevin Spacey unexpectedly showed up in a Nantucket courtroom Monday for a pre-trial hearing in the groping case against the actor, a surprise considering the 59-year-old actor was not required to attend the hearing and has generally tried to avoid appearing at the courthouse. Spacey's lawyer asked for access to the cellphone of the man who says Spacey groped him at a bar on the Massachusetts resort island in 2016, and in court accused prosecutors of withholding information and asked the judge to set a trial date ASAP as Spacey is "suffering" from the lack of a resolution. The judge said the earliest a trial will start would be the fall, WCVB reports. Also revealed during the hearing: No surveillance footage exists from the bar on the night in question, CNN reports.

Spacey spoke only in whispers to his lawyers during the hearing, and did not address reporters outside the courthouse. His attorneys have been questioning the accuser's credibility, filing court documents Friday alleging that the man deleted text messages that will support Spacey's insistence that he engaged only in "consensual flirtation" with the man, who was at the time an 18-year-old busboy at the restaurant and bar where the assault allegedly occurred, and also that he provided screenshots that only showed information backing his story. They want a "complete and unaltered" forensic copy of the accuser's phone, as well as his mother's phone, as they say it contains information relevant to the case.
