The Taco Bell exec fired for allegedly assaulting an Uber driver apparently believes that the best defense is a good offense: Benjamin Golden has filed a $5 million lawsuit against driver Edward Caban, claiming that the driver illegally recorded him without his consent and the video of the drunken incident has ruined his life, reports CNBC. According to a court filing, the 32-year-old Golden "has suffered severe emotional distress, humiliation, anxiety, fear, pain and suffering, and the loss of his job" because of media coverage of the incident. Dashcam video shows Golden punching and slapping Caban after the driver tells him he is too drunk and orders him to get out of the car.
In the lawsuit, Golden, who is facing criminal charges over the Oct. 30 incident in Costa Mesa, Calif., suggests that it was the driver's fault, because it was "apparent to Mr. Caban that Mr. Golden was intoxicated when he picked him up, yet he continued to allow Mr. Golden inside his vehicle." A lawyer for Caban tells CNBC that the lawsuit contrasts with Golden's claim to have been "hugely remorseful" for his behavior. "It just tells me how disingenuous Golden was on his apology tour," the lawyer says. "What's he want to apologize for if everything was the fault of Edward?" The lawyer says that the recording was legal because Caban informed Golden that the ride was being recorded. (More Taco Bell stories.)
