Defense argued sentence violated accused baby-killer's rights

Casey Anthony is eligible to face the death penalty if convicted of first-degree murder, a Florida judge ruled today. Her lawyers had asked that execution be taken off the table in her trial for the murder of her 2-year-old daughter, Caylee, arguing that if the prosecution sought the death penalty, it would violate their client’s constitutional rights. The judge said that's for a jury to decide, the Orlando Sentinel reports.

"While the quantum of evidence sufficient to seek the death penalty will virtually always be an issue, that matter is generally best left for the jury,” the judge ruled. (More Casey Anthony stories.)
